LIABILITY RELEASE FORM

The registrant, desires to volunteer his/her time and physical and mental capabilities with respect to the Rascal Rodeo (the “Event”) which is promoted and organized by Rascal Rodeo, a Washington nonprofit corporation (the “Promoter”). The Volunteer understands that his/her agreement to each of the terms and conditions contained in this Informed Consent and Liability Waiver (this “Waiver”) is required by the Promoter before the Volunteer will be permitted to do so. The Volunteer hereby acknowledges and agrees that the headings used in this Waiver are provided for convenience only and will not affect the meaning or interpretation of any provision hereof.

Acknowledgment of Risk - General
The Volunteer understands that there are inherent risks associated with the organization and operation of the Event, including, but not limited to, musculoskeletal and cardiorespiratory injuries, death, and damage to personal property. The Volunteer acknowledges that his/her assistance with the Event is his/her own voluntary act, and the Volunteer agrees to take full responsibility for any and all complications and/or injuries arising therefrom. The Volunteer has consulted (or will consult) with his/her personal physician or other qualified health professional regarding the Volunteer’s ability to assist with the Event as a volunteer and has not been advised against doing so.

Acknowledgment of Risk - COVID-19
The 2019 novel coronavirus disease (COVID-19) (the “Disease”) has been declared a worldwide pandemic by the World Health Organization and is reported to be extremely contagious. The state of medical knowledge is ever-evolving, but the Disease is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and in the air. People reportedly can be infected and show no symptoms and therefore spread the Disease. The exact methods of spread and contraction are unknown. Evidence has shown that the Disease can cause serious and potentially life-threatening illness, and even death. The Volunteer is aware of the highly contagious nature of bacterial and viral diseases, including, without limitation, the Disease, and the risk that the Volunteer may be exposed to or contract the Disease or another disease or illness (each, an “Illness”), by participating in the Event. The Volunteer understands and acknowledges that such exposure or infection from the Disease or other Illness may result in serious illness, personal injury, permanent disability, and death. The Volunteer acknowledges that this risk may result from or be compounded by the actions, omissions, or negligence of others, including the Promoter or its employees, invitees, and agents. The Volunteer understands that while the Promoter may have implemented preventative measures to reduce the spread of the Disease and other Illnesses, the Promoter cannot guarantee that the Volunteer will not become infected with the Disease or any other Illness while participating in the Event, and that participating in the Event may increase the Volunteer’s risk of contracting the Disease or another Illness. NOTWITHSTANDING THE RISKS ASSOCIATED WITH THE DISEASE AND OTHER ILLNESSES, THE VOLUNTEER ACKNOWLEDGES THAT HE/SHE IS VOLUNTARILY ENGAGING IN THE EVENT WITH KNOWLEDGE OF THE DANGER INVOLVED. THE VOLUNTEER HEREBY AGREES TO ACCEPT AND ASSUME ALL RISKS OF PERSONAL INJURY, ILLNESS, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE RELATED TO THE DISEASE OR ANY OTHER ILLNESS, ARISING FROM ENGAGING IN THE EVENT, WHETHER CAUSED BY THE NEGLIGENCE OF THE PROMOTER OR OTHERWISE.

Release
The Volunteer is aware of, and willingly accepts, the inherent risks associated with assisting with the Event as a volunteer, including, but not limited to, serious personal injury (including paralysis), death, contracting the Disease or other Illness, and damage to personal property. THE VOLUNTEER, FOR HIM/HERSELF, LEGAL REPRESENTATIVES AND SUCCESSORS, HEREBY FOREVER RELEASES AND DISCHARGES THE PROMOTER AND ITS EMPLOYEES, REPRESENTATIVES, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, “RELEASED PARTIES”) FROM ANY AND ALL LIABILITY FOR ANY INJURY, ILLNESS OR DAMAGES, WHETHER TO THE VOLUNTEER’S PERSON OR PROPERTY, RESULTING FROM OR RELATING TO THE EVENT.

Indemnification
THE VOLUNTEER, FOR HIM/HERSELF, LEGAL REPRESENTATIVES AND SUCCESSORS, HEREBY AGREES TO INDEMNIFY, DEFEND, AND HOLD EACH RELEASED PARTY FOREVER HARMLESS FROM ANY AND ALL LIABILITIES, OBLIGATIONS, PROMISES, CONTROVERSIES, SUITS, CLAIMS, DEMANDS, ACTIONS, CAUSES OF ACTION, LOSSES, DAMAGES, PENALTIES, INTEREST, OR FINES, AND ANY AND ALL COSTS AND EXPENSES, INCLUDING ATTORNEY FEES, COSTS, FEES OF EXPERTS AND ANY LEGAL OR OTHER EXPENSES REASONABLY PAID OR INCURRED IN CONNECTION THEREWITH (COLLECTIVELY, “LIABILITIES”) ARISING FROM OR RELATING TO ANY ACTION OR FAILURE TO ACT BY THE VOLUNTEER.

CONSENT TO USE IMAGE

The Volunteer hereby grants permission to the Promoter and its employees, agents and assigns, to photograph and video the Volunteer’s image, likeness, and depiction while assisting with the Event as a volunteer (including both before and after the Event itself). The Volunteer hereby consents to and permits photographs and videos of the Volunteer to be used by the Promoter worldwide for any legitimate purpose, including marketing purposes, and in any medium, including print and electronic. The Volunteer understands that the Promoter may use such photographs and videos with or without associating names thereto. The Volunteer further waives any and all claims for compensation of any kind for the use or publication of photographs and/or videos of the Volunteer by the Promoter. The Volunteer hereby fully and forever discharges and releases the Promoter from any claim for damages of any kind (including, but not limited to, invasion of privacy; defamation; false light; or misappropriation of name, likeness, or image) arising out of the use or publication of photographs and/or videos of the Volunteer by the Promoter, and covenants and agrees not to sue or otherwise initiate legal proceedings against the Promoter for such use or publication.

The Volunteer hereby acknowledges and agrees that this Waiver and the Volunteer’s obligations hereunder are binding upon the Volunteer’s legal representatives and successors. If any provision of this Waiver is deemed to be invalid or unenforceable in any respect for any reason, the validity and enforceability of such provision in any other respect and of the remaining provisions of this Waiver will not be impaired in any way. This Waiver will be governed by and construed in accordance with the laws of Oregon, without regard to conflict-of-laws principles.
